Mujeres cautivas en “la tierra del Islam”

Abstract

Frontier conflicts usually lead to a careful regulation of captivity norms, given that this is the main reason for the loss of freedom in the Islamic world. Chapters devoted to the “Holy war” (jihād) in treatises on furūc al-fiqh tend to include numerous data in this regard, and more specifically on the personal status of individuals, when defining their rights and obligations. The present work focuses on the information given by some Mālikī legal sources on the issue of captive women.

Resumen

Los conflictos fronterizos son ocasiones en las que se hace necesaria la regulación cuidadosa de la normas referentes al cautiverio, pues es la causa principal de pérdida de libertad en el mundo islámico. En los capítulos dedicados a la “guerra santa” (ŷihād) de los tratados de derecho aplicado (furūc al-fiqh) se pueden hallar numerosos datos al respecto, especialmente, para definir el estatus personal de los individuos a través de sus derechos y obligaciones. Este trabajo centra su atención en la información que nos proporcionan algunas fuentes de derecho mālikí acerca de las cautivas.
